The owner of the land or property can create a lease, also expressed as an
interest in the land or property, by establishing a legally binding relationship
between parties. This arrangement is formally established through tenancy
agreements between parties.
Tenancy agreements can either be oral or written. Some tenancy agreements can
also arise from the conduct between parties.
Under Singapore law, the owner of the land or property is known as the
Landlord. The Landlord will enter into a legal agreement with the party who
wants to lease the land or property from the Landlord, known as the
Tenant/Lessee (in the case of HDB).
If the lease allows, or does not expressly prohibit, a Tenant may create a
sub-tenancy from an existing lease. This is known as sub-letting. However,
it is crucial to note that if the Tenancy Agreement expressly prohibits such
an arrangement and the Tenant goes on to create sub-tenancy, the Landlord
has the right to terminate the tenancy for breach of Tenancy Agreement.
